By virtue of an Agreement between Infosuisse and the WIPO Mediation and Arbitration Centre, our members are entitled to reduced fees in cases with a litigation value until USD 500’000. In such cases, the Mediator’s fees shall be of USD 5'000 (instead of the daily and hourly rates stated in the normal fee schedule), and if the case goes to Expedited Arbtration, the sole Arbtrator’s fee will be of USD 10'000 (instead of USD 20'000 according to the normal fee schedule).
In order for our members to be entitled to these reduced fees, it is required that the Agreement at the basis of the trade relation between the parties (Distribution, Agency, Joint Venture etc.) include a Mediation and/or Expedited Arbtration Clause according to examples we may provide. As to the General Conditions of Sale (GCS), a simplified clause is sufficient (e.g. the sample text of GCS in our Member Space).
Cambodia has become the 95th member of the Madrid System, following the deposit with the Director General of WIPO on March 5, 2015, of its instrument of accession to the Madrid Protocol Relating to the Madrid Agreement concerning the International Registration of Marks. The Protocol enters into force, with respect to Cambodia, on June 5, 2015. Please don't hesitate to ask for our fee schedule regarding access to the Madrid System for your trademarks.
As from May 11 and June 6, 2015 respectively, official fees for designating and renewing trademarks in Norway and Estonia through the Madrid System have decreased. Of course, this will be impacted on our fee schedule.
Kindly note that the political situation in Libya continues to be turbulent and unstable. Nevertheless, trademark applications can be filed at the Trademark Office which is currently under the control and management of the Fajr Libya party. Whilst it is not certain whether applications filed at this stage will be considered valid should the political situation change and the Government regain control, we suggest at this stage to move forward with filing applications that involve short deadlines such as renewals, trademark applications with priority claims, etc.. The purpose here is to avoid missing out on any deadlines during these unpredictable times.
Please be informed the Official rates have experienced a significant increase due to the implementation of an article in Law that partially reforms the Tax Stamp Law. The new tariff has been implemented as of May 28, 2015. All instructions received by our local agent before this date have been treated according to the old tariff.
